NON PAYMENT OF ARREARS TO PRE-2006 PENSIONERS -CIR 547.



The  CDA circulars 547,  548 and 549  were issued in the month of September 2015  for the payment of Arrears  to Pre-2006 retirees. About 4 months passed.
But large number of defence pensioners are still not received their arrears .
It is heard  that  some Banks have paid to few pensioners and some Banks are not aware of these circulars.  Some CPPCs have instructed their Branches to calculate and pay the arrears at their end. Some are on the job ,Some Branches are  telling   we do not know how to calculate 

This is the position  and the ultimate sufferers are the poor pensioners.


Our Welfare Trust has assisted some Banks  in this regard  and ready to extend help if the bank branches request us.
We give below some hinds  How to calculate the arrears. We hope the Banks  will take these points in the right spirit.. 

HINTS FOR CALCUATION OF ARREARS – PRE-2006 -
 RETIREES  -CIR 547/548/549.

1.       Take  the PPO.
2.     Find out rank,  Group,  Qualifying Service  and date of discharge.(Pre-1996  / 1-1-96 to 10-10-1997/ 10-10-1997 to 31-12-2005).
3.     Find out the Rate of pension as per Cir 430   and 547  according to the rank, group and  Qs, Date of discharge.
4.     Arrive the difference   547-430.     If the difference is  negative, no benefit.
5.     Multiply the difference  by 46.02 for PBOR.  ( 1-1-2006 to 30-6-2009 – 42 months)
6.     Multiply  the difference  by 103.65 for Hony. Officers,  Commissioned Officers and Family pensioners.  ( 1-1-2006 to 23-9-2012)
For Example:    Take  A Hav-  Gp-   y -  22 yrs.of servise;   Discharged in -1994

Pension as per cir 397/430=  4746

 As per Cir  547……………….. =5019   The difference =273 per month.

Arrears from 1-1-2006 to 30-6-2009 will be:  273 X 46.02=12564.


For  Hony.Capt:   16145-13850= 2295

Arrears ……………..2295 X 103.65= 23788


For Family  Hav. X /A  Gp-  4176-3500=676

Arrears:…………………..676 X 103.65=70068.

NOTE:  For Ts Nk,  Hony.Nk ,  Hony.Hav – See the Rate of Regular Naik/ Havildar in Cir 547 and reduce by Rs.1 and take the rate   and minus the rate of 430.
For Hony.Nb.Sub.     find our the Hav, Gp and Qs  of the Hony.Nb.Sub and arrive the rate at 547 and 430 and arrive the difference. (ref cir 549, para-2)

For DSC:
All the ranks of DSC-  Clerical Ranks  - refer tables of Y group  for the rank and group
All the ranks- Other than Clericals-    Refer Tables of Z group for the Rank and Groups.

RESEERVIST  AND LESS THAN 15 YRS OF SERVICE  NO Arrears.

Invalid pensioners-  i.e  PPO with  IP indication  - no arrears.


CAUTION: For Family pension-  find out the Rank, Group and Qualifying service of the pensioner and date of death, Type of FP- Normal, Enhanced, Special or Liberalised. first, then  go for calculation.(verify the present rate also).
At present only Normal family pension is considered:
Pensioner died before 1-1-2006 :For the period 1-1-2006 to 24-9-2012.
Died after 1-1-2006  then LTA .
Arrears amount=  Cir 547- cir 397.Family pension Chart.
For eEnhanced / Special/ Liberalised –no instructions so far. We have to wait.

HAPPY NEWS FOR PRE-2006 RETIREES.-FULL PENSION 50%




The Maximum service of 33 years for full pension is removed for Pre-2006 retirees also.

As per 6th Pay commission, this condition was applied to Post 2006 retirees.

Now, Punjab and Haryana High court has given the verdict to this effect.

Hence, those who have put up 15 years of qualifying service are eligible for full pension. That is 50% of their emolument as pension  and no more Prorata. 





Good news PMR Cases. 
Pb and H High Court quashed proportional pension Rule for pre 2006 PMRs.  Judgement Case No, 
CWP-3423-2014 and other connected cases -19- 

Extract..  Rules where the pensioner had less than the maximum service of
33 years required for full pension are quashed. It is directed that
the pay of the petitioners who have retired before 01.01.2006 be
brought corresponding to the revised pay scale as per the 6th
Central Pay Commission and then it be ensured that pension
fixed is such that it is not lower than 50% of the minimum of the
pay in the pay band and the grade pay thereon. The respondents
are directed to refix the pension of the petitioners accordingly
and pay the arrears of pension within a period of two months.

TRUST REACHES OUT TO A SAURYA CHAKRA HOLDER AT HIS RESIDENCE.





 Our Financial Trust Sgt.C.Muthukrishanan , veteran, with Mr.G.Ramamoorthy  and his wife at his residence.

Our Trust Members visited a Saurya Chakra Holder at his residence
 on 25-12-2015.

Name: G.Ramamoorthy       A retired Chief  Engineer  from GREF.
Aged – 80 yrs.
Saurya Chakra Bar.Holder.

On our surprise visit , the Aged Engineer and his wife  were very happy for remembering them and expressed their gratitude .

We also verified his pension documents and confirmed that he is being paid correct Rate of pension.

AGAIN ONE MORE PRE=1984 VETERAN HELPED FOR JOINT NOTIFICATION.

One veteran N.Dhanapalan visited  our Trust office for conquering regarding Arrears of pension- Cir 547.


Name: N.Dhanapalan        Rank: Sepoy   Group- D     RO. ASC (MT).
He is a Disability pensioner for life.  PPO> D/ 6200/1974.

On going through his available documents, we noticed that he has put up only 5 yrs of service and discharged on Disability pension for life, hence no arrears as per Cir 547.

During  interaction , we came to know that he has not applied for Endorsement of Family pension.
But here is Part II order for his marriage.
So, immediately we prepared the applicable Appendix-I, Annexure-II  in Triplicate and guided him to forward the same to his Record Office through his PDA.

The innocent veteran was so pleased with our valuable service and thanked us for the timely help  .

We are satisfied by helping  one more veteran.

YET ANOTHER PRE-1984 VETERAN HELPED FOR ENDORSEMENT OF FAMILY PENSION.

YET ANOTHER PRE-1984 VETERAN HELPED FOR ENDORSEMENT OF FAMILY PENSION.

The  under mentioned veteran  called on our trust office  for verifying the  correctness of his pension and the non receipt of arrears as per CDA Cir 547.

Name: Krishnasamy Gengannan
Rank: Sepoy          Group-  E     Driver MT.   RO.   MRC.
PDA: Indian Overseas Bank- Tuticorin Dist.
 

On going through his PPO and Bank pass book, we confirmed that he is being paid  correct rate of  pension for Group- E.  actually he is eligible for a pension of Group- D/ Y.
We filled the Annexure for Change of group as per CDA cir 478 in triplicate.
The arrears as per Cir 547 is not paid to anybody in his , Branch . We told him to wait for some more time and provided him with a calculation sheet to present to the Branch. 

Again we noticed that he is of Pre-1984 retiree , not  applied for Endorsement of Family pension.
We explained him  regarding the importance of Joint Notification and  prepared the 
Appendix- I, Annexure-II  and Additional information on the spot  in triplicate and  guided him to forward the same through his PDA to his Record Office.

The Veteran was so happy with our action and  thanked us for this valuable help

Our  Trust  is also happy in helping one more veteran for joint Notification.
