ENHANCEMENT IN FAMILY PENSION



 DEMAND FOR ENHANCEMENT OF FAMILY PENSION

While the Service pension was enhanced for the Other Ranks from Sepoy to Sub. Maj. w.e.f. 01.07.2009 by the recommendations of the Cabinet Secretary’s Committee, corresponding enhancement was not given to family pensioners.  It was a great disappointment to the family pensioners.

Since Service Pension is fixed at 50% of the pay and family pension at 30%, any increase in service pension should have been allowed to family pension also.  Unfortunately, the MOD and Dept. of ESM Welfare was intentionally confusing the issue and denying the legitimate increase for the family pensioners.

This grave anomaly and the injustice was explained in detail by the IESM Chairman with a group of widows to the Hon. Defence Minister and the UPA chairperson Smt.Sonia Gandhi on 14 Nov 2011.  The Defence Minister was convinced over the legitimate demands of the widows represented by the IESM and it seems now that the MOD has finally agreed to enhance the family pension of other ranks in line with the revision done for service pension.

It is not known as to how the MOD will draft the changes.  However, ordinary soldier and the bottom most family pensioner expects the following minimum improvement in the family pension if it is accepted in proper perspective.

The following table will show the existing family pension and the expected improvement in the family pension, if implemented.

At present the minimum family pension is Rs.3,500 for all the above three Ranks irrespective of their group.  There is no relevance for the Rank.  This is a grave anomaly and injustice.  Our sincere thanks to IESM for taking up the matter.

YET ANOTHER SUBEDAR HELPED.



Ex.Subedar K.Vadivelu is receiving a copy of our submission to the PDA from our Liaison Officer, Sgt.S.Kanthiah,

In our continued efforts in finding out the discrepancies in pension payments, we came to know that one Subedar was getting less pension than his counter part.

Name: K.Vadivelu Rank: Subedar Group- Y Qly.Ser: 28 yrs
PPO.No: S/ 033084/2004 and S/CORR/040786/2005
PDA: Canara bank, Kayathar, Tuticorin-Dist.
Presently paid Basic pension: Rs.10532/-pm.

As per CDA Cir 430, Table 37, he is eligible for a Basic pension of Rs.11970/-.

The discrepancy was immediately reported to the PDA. The Manager was kind enough to accept our findings and submission and agreed to revise the pension and pay the arrears in this month itself.

The pensioner called on us and expressed his sincere thanks to the Trust for such a valuable service.

ONE MORE AGED VETERAN HELPED


      Veteran P.Nambi is receiving a copy of the Annexure from our Liaison Office.
ONE MORE AGED VETERAN HELPED FOR GETTING HIS PENSION REVISED.

It came to our knowledge that the under mentioned veteran was getting only the minimum pension of Rs.3500 and Additional pension of Rs.700/-.

PPO.No: S/ 6393/94 PDA: Canara Bank, Srivaikuntam, Tuticorin-Dist, TN.
He had completed only 12 yrs and few days of service.

He is also eligible for a revision , but through the Pension Sanctioning Authority, CDA Allahabad.

In this connection, we prepared the required Annexure in Triplicate, got it signed by the PDA and sent it to CDA through the Signals Record Office.

As the pensioner was not aware of this, he called on us and thanked us for this timely help in his fag end of his life.

Our Trust is also happy in guiding and helping one more Aged veteran to receive the revised pension soon..

ADDITIONAL PENSION- ELIGIBILITY AND PROCEDURES-



ADDITIONAL PENSION -80 YRS AGE AND ABOVE PENSIONERS

As per 6th Pay commission, those who have completed 80 yrs of age and above are eligible for Additional pension. 20%, 30 %, 40%, 50% and 100%., For 80, 85, 90, 95 and 100 and above completed yrs.

For that, the date of birth is to be confirmed/ verified.

Verify the PPO/ Discharge certificate for date of birth, if available it is OK

Some times , only age on Enrolment/ Discharge will be mentioned. In such cases, we have arrive the Date of birth/ year as under :

Suppose, Date of enrolment was 7-9-1948 and age on enrolment was 19 yrs, then his birth was 1948 minus 19= 1929. So his date of birth may be taken as 1-1-1930, that is where ever the date and month is not known, then we have to take the First day of the next year, in this case, we can take it as 01-01-1930.

In case, where no DOB and no age is mentioned in any of the service Records, then we have to call for the other documents Like:

1.Matriculation certificate
2.Driving license
3.Voters ID
4.PAN card
5.Pass port
6. ECHS/ CGHS smart cards.

In this case, 4 copies of the age proof is to be submitted to the PDA , in turn the PDA will send three copies to respective Record offices for doing the needful. The Record office, after verifying the service particulars will forward to the CDA, Allahabad for issuing a Corr,PPO mentioning the age. This process will take about 6 months time. ( Ref CDA Cir 417)

Till such time, the PDA can release the Additional pension for 6 months. If the Corr. PPO is not received in 6 months, the PDA will stop paying the Additional pension, thus putting the pensioners in hardship.
When this difficulties were expressed by organizations like our Welfae Trust, the CDA has again issued another circular CDA cir 441, stating that if, only age is available/ or the other document produced and sent, the PDA can continue paying the additional pension , even if the Corr.PPO is not received with in 6 months.

Dear Veteran brothers, please inform and explain this procedures to the eligible veterans and their families and help them in getting their additional pension.

SIGNIFANCE OF LIFE CERTIFICATE-THE ANNUAL IDENTIFICATION


SIGNIFICANCE OF LIFE CERTIFICATE- THE ANNUAL IDENTIFICATION.

Personal appearance OF a pensioner to the PDA is must, once in a year in the month of November.

There are cases where the pensioner had already died, not informed to the PDA, the pension was being credited every months for years together, amounting to few laks.

In the past, the PDAs were not taking the Life certificate seriously/ not verified the existence(alive) of the pensioners. Some times, the pension was drawn by the relatives by fake means/ ATM cards etc.

There is a Rule that if the pension is not drawn for 12 months continuously, the pension will be stopped but the rule was not followed strictly by the PDAs. If it is stopped, then Revoking is a very difficult job. We have to approach Record office and the CDA , Allahabad, which may take very long time.

But, after creation of Centralized Pension Processing Centers(CPPC) in each Nationalised banks, all the DATAS of the pensioners are fed in to the computers including the last Life Certificate date. Hence, if we do not submit the Life certificate by the end of November , the Computer will automatically stop the pension payment.

To avoid such un pleasant happenings, all the veterans are requested to visit the Bank and submit the Life certificate in November every year.

Aged / bed ridden pensioners , not able to travel can, obtain a Doctors Certificate with reg.No.and submit to the Bank.

In respect of Pensioners drawing pension through DPDOs, they can either personally appear for identification or send Life Certificate obtained from the Bank through which they are drawing pension to DPDO.

Pensioners Residing out side India are required to produce Life Certificate counter signed by the Indian Embasy/ Indian High commission.

Dear Veteran brothers, please discuss among yourselves / enquire each other whether they have submitted the Life Certificate in this month to avoid un- necessary harassments/ financial hardship .

Our Trust members paid a visit to one orphanage home "UDAVUM ULLANGAL " at Palayamkottai on the occation of Childrens day on 14-11-2011.

Our Trust provided a tasty dinner to the 60 inmates of the home.

The children thanked us and performed a prayer for the well being of the Trust members.
Our Trust is happy in celebrating the childrens day.

Dear Colleagues,
The planned IESM rally was held today at Jantar Mantar, New Delhi. It had more than 2500 ESM and Service families from all over the country. There was palpable enthusiasm in support of continuing with our struggle for seeking justice for the ESM, fronted by OROP. There was also unanimity in demanding that we the ESM start using out voting strength in getting our just demands accepted.
A memorandum was thereafter submitted to the President highlighting the non-grant of OROP and discrimination against widows in not including them in the pension enhancement that was implemented in 2009.
Kudos to Maj Gen Satbir Singh, Group Captain Vinod Gandhi, Wing Commander CK Sharma and other team members for organizing the event in an excellent manner.

PENSION FOR RANK HELD FOR LESS THAN TEN MONTHS

One Air Force Corporal was holding a paid Rank of Sergeant for Less than 10months on discharge.

Name: S.Thangam Ser.No: 232134. Rank held=Sgt Gp-I Qly.Ser. 15 yrs.
He was sanctioned with pension for the Rank of Corporal.
PPO.No: S/24761/76, S/12421/76 Latest: S/CORR/ 2336/2011
PDA: DPDO, Chennai ( Union Bank of India, Chennai)

We took up the case with Air Force , Record Office, New Delhi , and CDA Allahabad, quoting the above MOD letter. It was rejected in the first instant. Again we represented the case with the condone facility. They were raising lot of queries. Though the Sgt. Was holding the rank for 7 months and few days, they were putting so many conditions.

After series of correspondences, for more than 2 years, now we have received the Revision , Corr.PPO revising the Basic for the Rank of Sgt, Gp-I, 15 yrs, with effect from date of discharge and as on date as Rs.5492/ w.e.f 01-07-2009. They have also mentioned the earlier Rates, period wise, i.e, IV th PC, V th PC and VIth PC/

The Sgt.is very happy and expressed his heart felt gratitude for the persistent efforts made by our Exwel Trust for such a long period

Our Trust is also fully satisfied for having achieved the result though it is after a very long time..

Dear veteran brothers, those who have held a higher Ranks( Paid) for less than 10 months, may try to get the benefit without loosing hope.

ATTENTION: Central Civil Pensioners/Family Pensioners and Authorised Pension Disbursing Banks

1. The Life Certificate has to be submitted by the pensioner/family pensioner lo any Branch Manager of Pension Paying Bank in the months of November each year. The scheme booklet (4th edition, 3 Dec 2004) detailing the “Scheme for Payment of Pensions to Central Government Civil Pensioners through Authorised Bank’s has been amended to include para 15.2 (i) which provides for an exemption from personal appearance of the pensioner in the bank. The same is quoted below for ready reference of all concerned.
“A pensioner who produces a life certificate in the prescribed form in, Annexure-XVII (given below) signed by any person specified hereunder, however, is exempted from personal appearance:

i. A person exercising the powers of a Magistrate under the Criminal Procedure code:

ii. A Registrar or Sub-Registrar appointed under Indian Registration Act.

iii. A Gazetted Government servant:

iv. A Police Officer not below the rank of Sub-Inspector in-charge of a Police Station:

v. A Class-I Officer of the Reserve Bank of India an officer (including Grade II officer) of the State Bank of India or of its subsidiary:

vi. A pensioned Officer who, before retirement, exercised the powers of a magistrate:

vii. A Justice of Peace:

viii. A Block Development Officer, Munsif, Tehsildar or Naib Tehsìldar:

ix. A Head of Village Panchayat. Gram Panchayat Gaori Panchayat or an Executive Committee of a Village;

x. A Member of Parliament, of State legislatures or of legislatures of Union Territory Governments/Administrations;

xi. Treasury Officer.
It is further stated that in the case of a pensioner drawing his pension through a Public Sector Bank the life certificate may be signed by an officer of a Public Sector Bank. In the case of a pensioner residing abroad and drawing his pension through any other bank included in the Second Schedule to the Reserve Bank of India Act. 1934, the life certificate may be signed by an officer of the Bank. A pensioner not resident in India in respect of whom his duty authorised agent produces a life certificate signed by a Magistrate, a Notary, a Banker or a Diplomatic Representative of India is exempted from special appearance.
It is requested that all banks may give the above wide publicity and circulate to all the branches for strict compliance and for information to pensioners.

The Military Veterans have also decided that incase the president herself does not accept the medals and the Memorandum, they will bring these back.

EXPRESSING GRATITUDE FOR TIMELY HELP


Smt.Ayyammal, expressing her Gratitude to our Managing Trustee,Sgt.R.Chellappa(retd) with the statement of bank account.

On our visit to Kovilpatti, we came to know that one Special family pensioner was receiving unrevised pension of Rs.5763/- instead of Rs.7000/-

PPO.No: F/ 36 /92
PDA: Canara Bank, Kovilpatti., Tuticorin Dist, Tamil Nadu.

We reported  the discrepancy to the Manager and he was kind enough to accept our findings and submission and promised t revise the pension and pay the arrears soon.

Now, the arrears amounting to a Lak plus is credited to Smt.Ayyammal's account.
Smt.Ayyammal, the widow came to our Trust office , all the way from Kovilpatti, 60 kilometers away and expressed her sincer, heart felt gratitude to our Trust members for helping her in getting the arrears in a critical juncture . Her daughter's marriage is fixed in the last week of November, and this arrears has released her from all the tension. Otherwise, she should have gone for borrowing from money lenders.

Our Trust is happy and satisfied in helping a widow in a crucial time.








SALIENT FEATURE OF SPECIAL FAMILY PENSION



                       WHAT IS SPECIAL FAMILY PENSION

Special Family pension is granted to the Next of Kin of military personnel’s whose death or Disability is attributed or Aggravated by military service conditions.

Special Family pension is granted to the spouse / eligible children and if the deceased ESM was un- married, then the SPl.FP is granted to dependant Mother/ father..

Special Family Pension is also granted when an Ex-Serviceman in receipt of Disability pension dies before / within 7 years after discharge/ Invalided from service subject to fulfillment of certain conditions.

Special Family pension is calculated at uniform rate of 60% of Reckonable emolument of the deceased subject to a minimum of Rs.2550/- from 1-1-1996 and Rs.7000/- with effect from 1-1-2006.

Special Family pension is granted for the benefits of entire family of the deceased ESM. Therefore, if the spouse is not supporting the other family members like mother-in-Law, then the competent authorities may divide the pension to spouse and mother-in-law .

Special Family pension –PPO will bear the No. for example- as F/ 2121/ 2001

If the spouse dies leaving behind the eligible children/ dependant parents, then they will be granted Second Award of Special family pension at 50% of the Special Family pension . For example, the spouse was getting Rs.7000/, the second award will be Rs.3500/- After the Second award there will be no pension..

If the spouse got re-married, she can still draw the full pension provided she looks after the children born to the first husband.

Eligible cretaria for Special Family pension:

Diseases contracted because of continued exposure to a hostile work environment subject to extreme whether conditions or Occupational hazard resulting in death or disability would be examples.

Death or disability due to accidents in performance of duties such as :

a) Accidents while travelling on duty in Govt. vehicles or public / private transport.
b) Accidents during air journey on duty
c) Mishaps at sea while on duty
d) Electrocution while on duty
e) Accidents during participation in organized sports events/ adventure activities/ expeditions/ training etc.

WHAT TO DO WHEN A PRE-1984 RETIREE DIED WITHOUT JOINT NOTIFICATION




WHAT TO DO WHEN A PRE-1984 RETIREE DIED WITHOUT MAKING ENDORSEMENT OF FAMILY PENSION.

There was no Joint Notification of spouse in the PPO prior to 1-4-1984. Time and again it was emphasized to apply for Endorsement of Family pension by the Living Pensioners. It was not taken seriously by the pensioners. Many widows face financial harship due to the non-availability of Joint Notification.

When the pensioner dies without Joint Notification, the Widow has to do the followings:

Ensure that her name is in the Discharge Certificate/ PPO. If the Part II order has been published for marriage, the name will be there positively.

Intimate the death of her husband to the respective Record Office along with the Original Death certificate and also to the Bank branch from where her husband was drawing pension.
Then send a Claim  application for Family pension to Record Office..
If everything is in order in the service records, the record office will send the Claim form set in Triplicate.

The claim form will contain::
Non-Re-marriage certificate, LTA certificate, Bank details( she has to open a bank a/c) and other family details.
Pass port size photo( 3 numbers) duly attested by Soldiers board/ Gazetted Officer., Thumb impression of all fingers,
Legal heir certificate, Domicile certificate from Village Admin.officer , 2 witnesses by Local respectable people.
If the widow happened to be Second wife, then the particulars of the children born to the first wife to be furnished . In this case, if the children fulfill the conditions, then the pension will be divided.
The set of forms in Triplicate, duly filled, signed, attested to be send to Record Office through District Sainik board.
If there is un-due delay in claiming for pension, the reason to be informed
.
If all the particulars , required certificates are correctly sent, the Sanction order for Family pension will be received from CDA/ RO with in a period of six months.

All veterans are requested to help such widows in your area to avoid financial hardship to the grieved family.
